SAVE THE DATE: March 08th 2024, h 09:30-13:00
Politecnico di Milano organizes on a free lecture to offer a three-hour summary of the main topics regarding the Unitary patent and the Unified patent court.
The Unified Patent Court (UPC)
The Unified Patent Court (UPC) stands as a judicial body, featuring judges hailing from all participating Member States of the European Union. Its primary purpose lies in adjudicating matters concerning the infringement and validity of both Unitary Patents and traditional European Patents. Functioning as a shared court, the UPC serves currently seventeen EU Member States, with the Agreement on a Unified Patent Court (UPCA) having come into effect on June 1, 2023.
The Unitary Patent
The introduction of unitary patent protection streamlines the European patent system, offering inventors (whether individuals, companies, or research organizations) a simpler and more cost-effective avenue. By eliminating intricate validation procedures and significantly reducing translation demands across participating nations, it aims to catalyze research, development, and investment in innovation, thereby fostering growth within the EU.
Moreover, unitary patent protection enhances the safeguarding of inventions compared to the current framework. Presently, the substantial expenses associated with national validation and upkeep of European patents compel many inventors to patent their creations in only a select few countries. This limited scope diminishes the value of inventions, as the absence of protection in other jurisdictions renders them more susceptible to replication.
